Donegal County Council had granted permission to Vivo Shell Limited to redevelop a service station and shop at the site

The man was arrested on Friday morning for alleged offences contrary to the Non-Fatal Offences Against the Person Act 1997.

Creeslough's original shop was the Applegreen Service Station which was completely destroyed in the huge blast.

Donegal County Council last month granted planning permission Vivo Shell Ltd to move forward with a new development on the site of the tragedy.

Damien Tansey said the Donegal County Council was behaving as “if this was a normal development case in respect of which planning permission was sought"

An application was made to develop a petrol station, shop and memorial garden at the site of the Creeslough explosion.

Judge John Aylmer said there was a risk of the “whole thing blowing up” had some individual gone around the back of the frequently-used building for a smoke.

A file will be prepared for the Director of Public Prosecutions, a garda statement said

The two men in their 50s were arrested for alleged offences contrary to the Non-Fatal Offences Against the Person Act 1997.

Coimisiún na Meán said the documentary had breached the Broadcasting Act 2009 by causing harm/offence.

It is understood that the centre had helped young people affected by the Creeslough tragedy.

A service is to be held at the site of the blast in memory of the ten people who lost their lives last October.
