A serving member of the army has made a donation of €5,000 to various charities in the county after he appeared before Judge Vincent Deane at Ballaghaderreen District Court.
Mirslaw Jezuit, with an address at Kilmore, Athleague was before the court for assault contrary to section three of the non-fatal offences against the person act on June 15th, 2025 at Castle Street car park, Castle Street, Roscommon.
The matter had been previously adjourned in order for compensation or for a donation to be made.
The court heard the 22-year-old has been a serving member of the army for the last two years and had brought €5,000 in cash to court to be donated to charity as the injured party did not want compensation, saying he did not want to benefit from the incident.
The court heard that the two parties were known to each other with the defence adding that Mr Jezuit had exercised “poor judgement on the night. He was older and stronger, and he should have known better. This was a significant error in judgement. He acknowledges his wrong doing. He has a good career ahead of him in the army and he is very fearful of the impact a conviction would have on him.”
The court heard that the injured party will be compensated in a different forum and that “justice will be done.”
The judge noted a number of aggravating factors in the case, but said Mr Jezuit had a clean record before this and was a young man with his life ahead of him. “He has shown remorse. He has not just talked the talk but walked the walk. A conviction would have a huge lasting effect,” he added and went on to apply the Probation Act.
